Theranos

This Theranos record carries three bounded standing claims only: the posture of the SEC's 2018 civil complaint, the identity and posture of a December 2025 Ninth Circuit appellate document, and the Edison-assay denominators stated in that appellate record's trial-record synthesis.

Sources

6 bound source references · 0 source records · 0 source types / 0 retained capture associations

These counts cover only references bound through governed source identity. A zero means no governed binding is supplied here; it does not mean no source or capture exists, and captures described in the text are not counted unless bound.
This record treats several questions separately rather than as one undifferentiated narrative: what the SEC complaint posture establishes, what the Ninth Circuit appellate-document posture establishes, and what the appellate record states about Edison assay denominators. CMS/CLIA history, settlement disposition, separate criminal-trial outcomes, and FDA/testing-menu comparison remain outside this record's standing content.

Technology and testing

According to the Ninth Circuit's synthesis of the trial record, Theranos developed roughly 300 small-sample assays during Elizabeth Holmes's tenure, but only 12 of those assays were ever run on the company's own Edison analyzer; other general-chemistry tests were run on third-party machines instead. Collection method, analyzer identity, and assay identity are therefore distinct attributes of any given test, and this record addresses only the Edison-assay count the trial-record synthesis states — it does not, on this source alone, resolve which analyzer ran any specific test outside that count.

This record does not yet address the relationship between Theranos's marketed testing menu, the number of assays actually run on its own Edison analyzers, and the scope of the one FDA 510(k) clearance identified in TH-S15. TH-S15 is retained-but-unrealized in this corpus, so that comparison is held pending its realization rather than asserted here.

Source posture and procedural precision

Where a document sits is not who wrote it: a Theranos exhibit filed in a court docket is still a Theranos document unless the court expressly adopts its contents as a finding. The same care runs through the criminal record — a charge is an accusation rather than a determination of guilt; a conviction settles only the particular counts the jury returned; a sentence does not turn every allegation the prosecution narrated into an adjudicated fact; and a ruling on appeal answers the questions actually raised before that court and no more.

What we hold, and what we don't

This record cites six documents. Two — TH-S01 (the SEC's 2018 civil complaint) and TH-S09 (the Ninth Circuit's amended opinion) — are retained as captured copies of the documents consulted, and ground this record's three standing claims. Of the other four, TH-S02, TH-S05, and TH-S15 are retained-but-unrealized: they are tracked sources whose capture has not yet been completed. TH-S06 has no inventory slot at all: it is not yet tracked as a pending source in this corpus. Nothing about the CMS/CLIA regulatory record, the marketed-testing-menu/FDA-clearance comparison, or the separate criminal-trial outcomes are addressed by this record's standing content until those sources are realized or captured.

Regulatory and civil enforcement record

This record does not yet address Theranos's CMS/CLIA clinical-laboratory regulatory history. None of the six sources cited in this record is a CMS or CLIA document; that regulatory record is held pending capture and admission of such a source.

TH-S01, retained here as a captured copy, is the SEC's 2018 civil enforcement complaint against Theranos and Elizabeth Holmes. A civil complaint records the agency's allegations at the time of filing; it is not itself an adjudicated or admitted finding. This record does not restate the complaint's specific allegations as established fact — only that the complaint exists, was filed by the SEC in 2018, and names Theranos and Holmes.

Criminal cases and appellate review

This record does not yet address the outcomes of the separate criminal trials of Holmes and Balwani. TH-S05 (concerning Holmes's trial) is retained-but-unrealized, and TH-S06 (concerning Balwani's trial) has no inventory slot in this corpus at all. Both are held pending capture.

TH-S09, retained here as a captured copy, is the Ninth Circuit's order and amended opinion (December 2025) in the consolidated criminal appeals of Elizabeth Holmes and Ramesh Balwani. An appellate opinion is a distinct adjudicative layer from the trial verdicts and sentencing decisions it reviews. This record presents the captured opinion and its provenance chain; it does not restate the opinion's disposition of those appeals as an established outcome — the underlying criminal-trial outcomes are addressed separately, and are not asserted here.
